Danielle Posted September 24, 2021 Report Share Posted September 24, 2021 I’m looking for advice, Basically my landlord friend has rented out his property but at the start of the tenancy he never protected the tenants deposits, they are aware of this! One tenant has now stopped paying rent for 2 months, he would like to evict both the tenant, how can he go about it! He does have their bank details to return the deposit! Grampa Posted September 25, 2021 Report Share Posted September 25, 2021 Basically he has broke the rules and he can’t serve notice until the deposit is returned in full. He can then serve notice in the normal manner. If he doesn’t the notice will be invalid. However, as he failed to protect the deposit originally he has the risk of the tenants putting in a claim for UP TO 3x the value of the deposit. As he appears to be an inexperienced landlord I strongly advise that he instructs a professional eviction company to take it from here. Danielle Posted September 25, 2021 Author Report Share Posted September 25, 2021 Thank you so much for your reply, he has been getting advice and this is what his been told to return the deposit, although the tenants pay into his bank and he doesn’t have their bank details. They have no communication and are not very nice tenants, is there any advice on how he can return the deposit to them without their bank details. If I were the tenant i'd probably say no you can't have it, just give me a cheque. It might be advisable for the landlord to get the tenant to sign a receipt to say it has been repaid if a cheque is accepted. What a big, expensive, time consuming, stressful and totally unnecessary problem to sort out. Sounds like it could cost the landlord many months of effort and thousands of pounds to resolve.
