kerbut Posted October 22, 2012 Report Share Posted October 22, 2012 On behalf of my son, if he serves a Section 8 notice on 2 November (S 21 served today with expiry date of 31 Dec )can he start court proceedings on 16 November (ie. 2 weeks after service of the S8 ) . I think I know the answer but would hate to be "Dad you were wrong " !, he is using grounds 8,10,11 on the S8. Though you can deliver by hand you then need to fill out a statement to send in with any court aplication so I can always found it easier to to post 2 copies, one by recorded and the other with proof of postage. It doesnt matter if they dont sign for the recorded one I have always found the courts accept service and all you need to do is enclose copies of the P.O.S & R.D.
