I have it with a letting agents who manage the property for me. I have told the agents to send notice 21 to tenant when 6 months comes up on the contract. All was done and the tenant was suppose to leave 19th July 2011. However tenant was adviced not to leave and go to court as she would be making herself homless. The 20th July 2011 the agents sent a claim of possession form to courts via online. I told the agents the reason for me wanting the house back is for myself not for any other reason. I get a court hearing date for 7th September 2011. Which I went to. However, the judge told me the name on the form, the claimants name is that of the agents and not mine!! So of course the case was closed!! I went straight to agents and absolutely mad!! The agents said they would refund my court fee and re apply. I wasn't sure if i should let them as 1 mistake is more than enough. BUt me being me, let them apply and pay for the court fees. I receive a letter today from the courts saying the cheque is not for the right amount and we are sending back your form. Please send in again with correct fees of £175.00. the agents had sent a cheque for £100.00 only!!! Not even the £150.00 i thought they were sending!! I am now wondering what to do!!?? My contract on the house ends on 19th November 2011 and am wondering do I now have to send a notice 21 again to tenant for her to leave the house? I have a bad feeling she wont be leaving when contract ends!!! Any advice on what i should do?? (used to be £150) 3 A s21 possession procedure is normally done by post and cost £175. I do not think it can be done on-line so not sure what your agent is doing. (used to be £150) The paperwork for a s21 possession isn't hard but a lot of paperwork has to be sent to the court and it HAS to be correct. If your agent made a basic mistake with the names I wouldn't trust the rest is correct. As long as the original s21 is still valid and was served correctly it can be still used. I suggest you connect a specialist eviction company to do it for you and the costs are about £500 but i have seen as low as £350. DO NOT USE A HIGH STREET SOLICITOR UNLESS THEY SPECIALIZE IN HOUSING LAW. Link to comment Share on other sites More sharing options...

Was issused in 08th May 2011 and the 2 months date from that was 19th July 2011. Does it mean it has expired then? Do you think I will have to issuse it myself again.
