You are,  as long as you follow the prescribed legal procedure for eviction of your tenant.  Your tenant's deposit protected under the current Government housing law?  Any more details you can add to your post?

It would depend on the content and wording of the letter. It may be that the way it is worded you have arguably granted a new tenancy.
