proprietaire
My tenants are trying to prevent me from accessing my property to do renovation work. Are they legally able to do this?
Melboy
Yes and No. You don't say what the renovation work consist of.
proprietaire
The renovation work entails fitting a new kitchen. I have all of the materials, such as units, surfaces, sink etc. and I have the necessary skills to do the job. is this clearer?
Melboy
OK........ They may well have a case in not permitting the work to go ahead. Yes, it could be that a new kitchen would be a bonus but I guess if your Tenants are happy with what they have then they don't want the upheaval and mess of a new kitchen being fitted. It is usual for replacements and renovations of this scale to be completed at the end of the Tenancy and prior to re-letting. I was faced with the same problem last year regarding a bathroom re-fit but the Tenant didn't want it done during Her time in occupation....it was completed after She moved out. Hope this helps you out.
proprietaire
thanks. the fixed term tenancy agreement expires in mid august. i have already given them 2 months notice to vacate to coincide with the expiration date. will i have access then even if they refuse to vacate? Melboy
If, for any reason, your Tenants do not vacate after having been given 2 Months notice then you are still not permitted to enter the property to carry out renovation work. You are now on the Legal Process to get them out !! Hopefully, for you this doesn't happen.
proprietaire
thanks. my house is in newcastle upon tyne and i am currently living in Paris. How can I start the legal process to ensure vacation? Also, the house has two spare rooms available to rent (as stated in the contract), but the tenants did not find anyone. Is there anything to stop myself occupying this room as a tenant (so to speak)?
