He is currently in the fixed period but the expiry date of the notice will be in the periodic period of the tenancy. Which notice do I serve - on e for a fixed or one for a periodic? Grampa Posted September 28, 2011 Report Share Posted September 28, 2011 Sorry Mortitia that is incorrect if the tenancy is still in the fixed term a s21(1)( is used. Remember most s21(4)(a) (for periodic tenancy) have a saving clause nowadays that will state something like After the end of the period of your tenancy which will end after the expiry of 2 months from the service upon you of this notice. and that wouldnt apply if a s21 used and the 2 months notice started inside the fixed term but ended outside because in that case it can fall on any day as long 2 months notice given.
