A Captail gains tax question

My wife and i own a seconed property that we have rented outfor the last seven years. we have now decided to split up and I am thinking of moving into this rented propety and useing it as my home. This would mean not renting it out anymore. Would I or my wife be lible for captail gains tax on the house now or when i sell it and move on (in several years time).

It depends on if the property is owned jointly and forms part of a divorce settlement.

If its mortgaged that will require consideration.

If its a formal BTL then that usually doesn't allow an owner to move into it.

The solicitor dealing with your separation will normally sort it all out for your.
