salavan Posted April 14, 2009 Report Share Posted April 14, 2009 hi can anyone help me. i have been renting out my house for the last 5 years and my tenant is on a one month periodic tenancy. i would now like to move back into my house myself. could anyone tell me what notice i have to serve my tenant, and is there a special form i have to use, the tenancy runs from the 25th of each month. The minimum is ideally 2 Months but it would be advisable to make your Tenant aware of the fact that you will be applying for re-possession of your property and to sound out their requirements on timescale. partrim Posted April 17, 2009 Report Share Posted April 17, 2009 The two months notice must expire at the end of a 'tenancy period' - i.e. usually at the end of a rental period. Example - if a tenancy period runs from 10th of the month to the 9th of the month, then the 2 month notice must expire on 9th of the month. Most people will need a couple of months to find a new place and move. State a final moving out date when you speak to them, but try to be flexible.
