Kicking someone out

I'm asking this question for my mother as she isn't sure of what to do.

My mother is a tenant and has been given notice to vacate the property at the end of her tenancy - which is fine, no problem.

However, my mother and her fiance whom were due to marry in 11 weeks time had a rather explosive argument last night and he said he was moving out today - he hasn't (go figure)! His name is on the lease but he doesn't pay any of the rent or bills, as he's a bum and mooches off of her (don't you hate that type?) Well she's finally fed up with it. Problem is, she isn't sure if she can legally kick him out due to his name being on the tenancy agreement, even though he doesn't pay anything. She has 2 other children under the age of 13 who she needs to look out for, so gathering everything up and moving herself out would be rather a hassle considering she owns 99.99% of every belonging in the house.

So my question is, can she kick him out? Or does she have to leave herself because his name is on the tenancy agreement too, even though he doesn't pay for anything. Would we need to get the police involved for having him escorted out with his belongings?

Any advice would be greatly appreciated, as soon as possible please.

Thank you in advance,

Dottles

P.S. - I'm sorry if this isn't on the right forum.

She can't 'kick him out' if he is the Signature on the Tenancy document.

The rental agreement is between him and his Landlord and not your Mum. The fact your Mum pays the rent is a private arrangement between themselves and holds no basis in contract law.

You can only hope he doesn't realise this fact and just goes but I would doubt this very much as he hasn't gone yet even though he said he would.

Mel.
