Trenners Posted September 30, 2007 Report Share Posted September 30, 2007 Hi, No - you probably won't be able to get them out before the end of the Section 21 for non-payment of rent. The tenant needs to be 8 weeks behind with their rent (ie: 2 missed payments) before you can commence legal proceedings and, even then, you would need to give them 14 days to pay before filing the Section 8 notice. Given that you have already issued a Section 21 that expires in less than 8 weeks now - the quickest route will be to wait for the Section 21.
