Landlord101
Hi All, Once you have a possession order - how do you issue a CCJ? Do you go back to the court where hearing took place and fill the form and pay the fee?
Mortitia
You don't issue the CCJ the court does - and will have done. If tenant won't leave you need to get the court bailiff in (Fee £120)
Grampa
I dont think the court automatically does Mortitia. I know you can request the court costs when you fill out the paperwork for a S21 possession hearing but when you get awarded the eviction I dont think a CCJ for the costs automatically goes against the tenants name. I read or someone told me you have to apply for it somehow which I guess most landlords dont do because they are just glad to get their property back. (I could be wrong on this but dont think I am) A successful S8 hearing I agree does get a awarded by the judge at the time of the hearing.
Mortitia
I'll look into this one a bit more - can't have the B's getting away with it.
