Maysani
Do I have to return the deposit to the tenant at the end of the fixed term then take it back again and protect it with the DPS and issue PI as soon as the tanancy becomes periodic Or just issue the PI and leave the deposit where I keep it in the at the start of the tenancy (with DPS)
Grampa
Depends what your tenancy agreements state regarding a periodic tenancy. If it is a statuary periodic tenancy the current advise is to re-serve the PI, if the contract continues as a contractual periodic tenancy it is not necessary. Maysani
The tenancy contract of my tenant become periodic since 16th from March this year. The fix term contract started 16/03/2012 to 15th /03/2013. The deposit was protected with the DPS March last year and PI was served and singed by the tenant. Following the recent “Superstrike court ruling” do I have to re sever PI now or it is not necessary
