Grampa Posted July 7, 2013 Report Share Posted July 7, 2013 If there is a deposit and it has been protected correctly serve a section 21(4)(a) notice. Also as more than 2 months rent is owing you can serve a section 8 notice using grounds 8,10,11.With the s8 you can apply for a court hearing 14 after serving which will give a hearing in about 6 weeks later.The section 21 cannot be acted on for at least 2 months.The standard practice is to serve both notices (separately) in a situation like this.Is there a guarantor and if so have you trying chasing them yet. Grampa Posted July 8, 2013 Report Share Posted July 8, 2013 She may be still getting a certain element of HB and if so you are within your rights to write to the council to get it paid directly to you under regulation 95.
