O'Neil Posted June 1, 2006 Report Share Posted June 1, 2006 Hi - got a bit of a tricky problem and help would be appreciated. I moved into a flat on an ast - normal six month letting. One month into the tenancy I agreed with the landlord to revise the rent to take into account changes in council tax - all agreed, although it meant some delay in paying my second and third months rent due to my companies invoicing system. He has now received the second months rent and the third months rent for May wasn't received by him until 29th of the month but the landlord has not signed and returned the revised tenancy agreement. Today the landlord was not happy with the delays in paying rent and gave me one months notice to leave. I said I was supposed to have two months notice to tie in with my leaving at the end of six months. He stated that he had not signed the revised tenancy agreement and therefore would only be giving me one months notice to be out by the end of June. Where do I stand? Can he do this? My company invoicing system will be paying his rent on time now - well as soon as he returns the signed tenancy. Help. Link to comment Share on other sites More sharing options...
Trojan Posted June 1, 2006 Report Share Posted June 1, 2006 ONeil, There is a long answer and a short answer, so I will spare you the long one and give the short one. NO he cannot do this, signed or not signed you have a term certain of six months whether written or not. He is still obliged to serve the statutory two months notice to expire at the end of the first six months. Hope this helps, if you need morw assistance email or or leave a message here. Trojan Posted June 2, 2006 Report Share Posted June 2, 2006 Hi O'Neill, Rather than going out to a solicitor and costing you money you could try one of the "Law Centres", a little bit more specialised than the CAB, it is a charity and most deal with Housing issue above and over anything else. Being an agent I have been on the receiving end of letters from them from time to time, they are not nice; they don't beat around the bush.
