LLAW96 Posted August 21, 2012 Report Share Posted August 21, 2012 This situation always makes me laugh see s.1 Landlord and tenant act 1985, or spend £4.00 and undertake a land registry search. Doing this serves no purpose as the agent has no interest in the premises and therefore cannot issue proceedings to evict a tenant. It can cause landlords all sorts of problems and costs. I was just curious as to whether the SHTA was invalid as the Agent had named themselves as the Landlord not as "The Landlord's Agent". I realise the Agent's address would be suitable for the serving of notices and proceedings Landlord and Tenant Act 1987 s.48 but would it have to have my name too to comply?
