Tonyj
I am hoping someone can advise me please. If a tenant holds an assured tenancy on a property they have lived in for 20 years, can they retain their protected status if: 1) They move out temprorarily to allow the landlord to undertake repairs 2) They agree to the landlord's offer of rehousing them permanently in a smaller property? Any help gratefully received.
Melboy
No the assured tenancy relates to the property on the document. If your tenant moves permanantly at their own choice they will lose that protected 20 year guaranteed tenancy occupation. If it is just a temporary situation due to essential repairs then the guaranteed occupancy remains with them when they move back in to that ptoperty. Any doubts on this speak to a specialist property Lawyer to confirm what I have said is true and factual. www.mundys.co.uk <-------this is not me! but an excellent approachable specialist property lawyer that I use.
