salavan Posted March 27, 2010 Report Share Posted March 27, 2010 can anyone advise me i have a tenant who is now 3 months in arrears with the rent, i am about to issue him with a section 8 notice, i would like to know what my position would be if after reciving the section 8 notice he pays 2 months of the rent and still owes 1 month, as i suspect this is what he will do. is the section 8 now void? The answer is yes it will be void which is why you should have done a section 21 ( at same time to back up the section 8 and at least get posession. SPEEDTWIN Posted March 28, 2010 Report Share Posted March 28, 2010 But if you use grounds 10,11 as well as ground 8 to go with the s8 you will still have a fighting chance of getting a eviction order and even more so if they dont go to court to defend it.
