Are solicitors fees for a boundary dispute on a rental property classed as an allowable expense for tax purposes or can you only claim them back as capital gains? I can certainly say that this would not be allowable as a cost against the rental business as it is not incurred in connection with the running of the rental business. However whether it is an allowable cost against a future sale is less clear cut and there is nothing I can specifically find on the subject to provide a concise answer. If this is a sucessful boundary dispute I would be inclined to allow the costs as arguably the sucessful arguement of a boundary dispute will be reflected in the sale cost at the time of disposal. If you are unsucessful, to be honest it is a bit of a judgement call I think. Sorry I can't be more clear cut without knowing your tax affairs and situation in more detail, but hope this is helpful anyway.
