GPEL
New one on me. 2 properties in a converted house. Ground floor owned by freeholder, 1st floor owned by leaseholder. Leaseholder made a claim under the freeholders buildings insurance and received a payment from the insurers, less the £100 excess. Is it reasonable to expect the freeholder to contribute 50% to the excess lost by the leaseholder making a claim on the freeholders policy? IE should both freeholder & leaseholder bare the excess burden, not just the leaseholder?
Selkirk
Could be wrong but on the contrary I would have thought the excess was entirely down to the freeholder, it's for the upkeep of the building.
