Caroline.eason
Hi all, I am about to sign up a tenant to an AST agreement, the agreement has a guarantor section which we both have to sign. Does anyone know whether the we have to sign in front of each other as he lives many miles away from me and our rental property? Thanks Caroline
Simon Dewsberry
Hi Cazzy No you dont need to both be present - but as you are the one taking all the risk - you dont want to be in position at a later date when they could deny that they ever signed it and the signature is actually that of the pet dog !! If you want to do this properly allow space for a "witnessed by" box - for each signature, include; name, address, date, tel no. & relationship to person signing. (bolt and braces- which in today's world, unfortunately is becoming a necessity !) If you do this then you also have another point of contact should the guarantor become difficult to locate when you need them ! Hope this helps !
