Nigel Posted May 10, 2006 Report Share Posted May 10, 2006 I have gone through the whole procedure to remove a tenant. The court issued a possession order in my favour last week. The tenant did not move out. Now the confusion. I have seen numerous statements saying I MUST use bailiffs to evict. I have seen others which say I can carry out the eviction. I spoke to the local Police and they said they are happy to support me and be present if I chose to enforce the pssession order myself. Who is right? On a point of law, surely if the possession order has been granted then the tenant no longer has legal possession. The reason he can be evicted is that he is now a trespasser and not a tenant and I am allowed to use "reasonable force" . If the police are present surely this cannot be illegal eviction?
