LICENCE AGREEMENT

Hello there,

Could I ask if having made a contract as a LICENCE AGREEMENT, I still need to register a deposit as a landlord?

Hi Jolly,

You should have posted this on Landlord not Tenant. However, yes, the lastest thinking is you do need to protect the deposit as a licence is deemed to be a contract.

But if it was for the purpose of a lodger and you are a live in landlord then you dont need to protect the deposit.

This is a new on on me !

my understanding is the dep pro ONLY applies to an AST - nothing else ?

Where can we find some of the "latest thinking" ?

OP should also be aware that if it the letting situation looks like an AST & smells like an AST then it may well be regarded as an AST ...even if it is written up as a LICENCE :huh:
