I thought we were down to using 1 S21 these days,

Aren't the previous 2 now redundant in favour of a S21 that is 2 months from any date served, as apposed to the previous being required to end at the end of a rent period?

Just an update

we submitted the deed of surrender to the council

they said they have never seen one of these before (took over 2 weeks to let us know)

he went to the council they told him because he has paid a bit of rent while daughter in hospital that they think That makes him a tenant ?

if that is so then we are going to go down the section 21

but how does it work for the rent owed that should make him libel then as a tenant

what is is the shortest time to get him out 

he stopped paying rent Nov 8

it feels like we are never going to get this man out

I have heard of so many people running around in circles disappearing up their own backside in an attempt to sort out this kind of tenancy problem out. One small mistake and you are back to square one.......

My advice is to employ a specialist who will immediately know the correct course of action, complete the correct forms, serve them correctly and get your tenant out by the quickest method.

Some Council personnel knowledge on Tenant/Landlord law is quite dismal (personal experience on this). The advice given to him, if true, is utterly wrong.   Only a Court judge can make that decision and it is very unlikely that they would find in favour given the evidence.  Like RL says get a professional eviction company onto the case to speed things up.

If you join the Guild of Residential landlords https://www.landlordsguild.com/ which I think is £90 for the year for an landlord they will (with out any doubt) help you get your property back,I can guarantee it having been a member for the last 10+ years.

They have helped me numerous times with evictions etc in my position as a letting agent. They go the extra mile.
